Terms of Use

These terms govern your use of webmarlin.com and the Webmarlin website builder at app.webmarlin.com (together, "Webmarlin" or "the service"). By creating an account you agree to them. If you are using Webmarlin on behalf of a business, you confirm that you can agree to these terms for that business.

1. Your account

You must be 18 or older to hold an account. Keep your password private; you are responsible for everything done under your account. Tell us promptly if you think someone else has access to it.

5. Selling with the store

If you enable the store, you are the seller of record for everything sold on your site. Payments are processed by Stripe under Stripe's terms, and Stripe's processing fees apply. Webmarlin also charges a transaction fee of 2% of each order total, collected automatically through Stripe at the time of payment. You are responsible for your products, prices, taxes, shipping, refunds and customer service. Webmarlin provides the storefront and order records only.

6. Acceptable use

Do not use Webmarlin to publish content that is illegal, infringes someone else's rights, is deceptive, contains malware, or harasses or harms others. Do not attempt to disrupt the service or access other users' accounts or data. We may remove content or suspend accounts that break these rules, and we will tell you when we do unless the law prevents it.

7. Availability and changes

We work to keep Webmarlin available, but we cannot promise uninterrupted service. We may change or retire features over time. Where a change materially reduces what your paid plan includes, we will give you notice.

8. Ending your account

You can delete your account at any time from your dashboard. Deleting your account unpublishes your sites and removes your content after a short grace period. We may close accounts that remain unpaid or that breach these terms.

9. Liability

Webmarlin is provided as-is. To the extent the law allows, Webmarlin is not liable for lost profits, lost data or indirect losses arising from your use of the service, and our total liability to you is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law.

10. Changes to these terms

We may update these terms and will update the date at the top. Material changes are announced by email or in your dashboard before they take effect. Continuing to use Webmarlin after that means you accept the updated terms.
